Township Board & Commission Vacancies . . . Appointments Without Partisan Politics

Last night was the first meeting of the township’s new Historical Commission. The seven members of the HARB (Historical Architecture Review Board) were appointed to the Historical Commission. The new commission was established with nine members.

A Community Matters reader reminded me that I should advertise the two vacancies on the Historical Commission. We need one of the positions to be filled by a certified architect and the other would be for someone with a background/interest in historic preservation, history or archeology. I and three other Historical Commission members are working on a Chester County historic resource mapping project which has been fun – we’re locating and identifying all properties that are 75 years or older in the township, that were not included in the historic resource survey the HARB did 6 years ago. Unfortunately, we have discovered a number of the historic resources no longer exist.

If I am going to name the vacancies on the Historical Commission, I thought it would be good to review all the boards and commissions in the township . . . and see where there are other vacancies. Municipal boards, commissions and advisory committees exist to further the township’s success through the volunteer participation of citizens in the daily business of community government.

The following vacancies currently exist in the township. If you visit the township website, www.tredyffrin.org you can read the requirements and mission of each of these boards.

  • Cable TV Advisory Committee (CATV) – 1 vacancy
  • Environmental Advisory Committee (EAC) – 1 vacancy
  • Historical Commission – 2 vacancies, (one position is for certified architect)
  • Municipal Authority – 2 vacancies

How does the process work for board appointments? I assume that my appointment to HARB (and now the Historical Commission) is similar to other boards/commissions. If you are interested in serving and have the background, experience or skill requirement you send a resume and letter of interest to the township at tredyffrin@tredyffrin.org . The supervisors are notified of your interest and an interview time is scheduled. It has been awhile ago, but I think there were 4 supervisors at my interview.

I want to believe that all board appointments are made for the right reason. Appointments on boards and commissions should go to those that are best qualified to serve in that position. In the past, there has been talk of partisan appointments to some of the township boards. In response to this kind of discussion, I have deferred to the HARB (now Historical Commission) and its members. Historic preservation is very specific and those that serve are passionate about the history of the community and its historic resources. As an example, our group has always been without the bias of partisan politics.

However, is the policy of nonpartisan appointments the same if you want to volunteer for other township boards, such as the Zoning Hearing Board or the Planning Commission? In my world, I would hope that the Board of Supervisors would treat applicants equally and choose the best qualified candidate, regardless of their political party affiliation. There should be a sense of fairness to the board and commission appointments. Citizens should apply and feel they have an equal opportunity to serve on any board or commission, regardless of their political affiliation.

If they are the most qualified and have a willingness to serve, all citizens should be welcomed. If any of these vacancies appeal to you, I would encourage you to submit your resumes. It is a wonderful way to volunteer and help your community.

What’s the future of the Paoli Transportation Center project . . . Remember, ‘Rome wasn’t built in a day’!

I continue to wonder about the PA Department of Transportation’s interest in the Downingtown train station; the cost of purchasing land and building a new train station when the existing station is only 20 years old. I am certain that Downingtown probably needs additional parking but with one-third the daily ridership of Paoli, I am troubled how the Downingtown project, seemingly out of nowhere, appears to have shot to the ‘head of the class’ in interest for the DOT. With major budget cuts in Harrisburg, and a finite amount of dollars for transportation projects, there should be alarm for existing transportation projects such as the Ardmore Transit Center and the Paoli Transportation Center. Will there be enough money to go around to all these projects?

There is concern in Ardmore that their long-standing transportation project may likewise take a backseat to Downingtown, and the suggestion is that it is political connections – either by Downingtown elected officials or ‘lack of’ connections by Ardmore’s elected officials. Why does politics have to drive projects in Harrisburg? Is it the squeaky wheel that gets greased? Sen. Andy Dinniman’s jurisdiction covers both Downingtown and Paoli, so which train station project does he prioritize . . . the project that is years in the making (Paoli) or this new train station project in Downingtown?

Serving as state representative for the 155th legislative district, which includes Downingtown, is Curt Schroder (R-East Brandywine). A quick review of his website did not produce any news on the Downingtown train project, but I did discover that Schroder chairs the House Gaming Oversight Committee that is responsible for the state’s gambling industry. As a senior state representative, I am guessing that Schroder has a direct line to Harrisburg and the governor.

Back to the Paoli Transportation Center – some would suggest that what goes on in Downingtown has no bearing on Paoli; that these transportation projects are separate and apart. You know the saying, “Rome wasn’t built in a day”, I think that sums up the Paoli Transportation Center project. How does a community sustain interest in a project, when there appears to be so little forward movement?

In 1996, the Paoli Rail Yards Task Force composed of representatives from Tredyffrin and Willistown Townships, Chester County, Septa, Amtrak, Delaware Valley Regional Planning Commission, the US Environmental Protection Agency, PennDot and elected officials completed a feasibility study that recommended:

  • construction of a new station and associated facilities 800 feet west of the current station;
  • preparation of a conceptual transportation center, access and development plan; and
  • preparation of preliminary development costs and income potential.

Look again at the date of that study, 1996 . . . 15 years ago! We know that Rome wasn’t built in a day but how many years does it take to build the Paoli Transportation Center?

Last June 2010, there appeared to be a shot in the arm for the Paoli Transportation Center. Former State Rep Paul Drucker, a staunch supporter of the Paoli transportation project, announced $1 million in state funding from the Redevelopment Assistance Capital Program for the construction of the Paoli Intermodal Transportation facility and named Strategic Realty Investment as the project’s developer. Through Drucker’s efforts in Harrisburg, there seemed to be a renewed sense of urgency and momentum to build the train station with on-site parking garage and new office and retail space. Evidenced by the $1 million in state funding, many of us saw this as kick-starting the project that would create jobs and provide economic stimulus for the community.

When Drucker lost his state house re-election bid in November, did the community also lose their most vocal supporter of the Paoli Transportation Center project? During the last 13 months, since the announcement of the $1 million funding, I have not heard of any ‘new’ news on the train station project. We saw the Paoli Transportation Center project used in campaign literature in November and by political candidates in the May primary, but what really has changed in the last 13 months?

Hoping to gain perspective and an update on the Paoli Transportation Center project, I contacted elected officials and supervisor candidates. The following individuals were contacted for comments: State Rep Warren Kampf, State Rep Dwayne Milne, Michelle Kichline and John DiBuonaventuro, (Tredyffrin Twp supervisors and members of the Paoli Rail Yards Task Force) Norm MacQueen (Willistown Twp supervisor) and Tredyffrin Twp supervisor candidates Kristen Mayock, Tory Snyder, Mike Heaberg, Paul Olsen, Murph Wysocki and Molly Duffy.

Understanding my short timeline for responses, coupled with summer vacation and work schedules, I accepted that some of those contacted would be unable to respond. However, I want to thank those that did take time from their busy summer schedules to offer their comments for Community Matters readers.

As a response for an update on the Paoli Transportation Center, I received the following from State Rep Warren Kampf:

Thank you for your email. I appreciate your concern as a constituent regarding the Paoli Transportation Center.

My recollection is that most of the legislators and County officials support this project. The PennDOT Transportation Improvement Plan (TIP) currently has the Paoli Transportation Center (MPMS# 47979 and MPMS #60574) as a priority project and Chester County has this listed at the top of their list.

Every few years the TIP projects are reviewed and that process is again underway. I will continue to advocate for the Paoli Transportation Center. Other communities have needs of course, but I consider Paoli to be a very high priority.

I would caution you or anyone who sees planning or activity on other projects, for example, Downingtown, as somehow linked to the standing of Paoli. The process does not appear to work that way as I understand it. My belief is any work related to Downingtown that would receive State funding would need to go through the TIP process, and I do not see it on the TIP list I have. Further, I presume that the size of that project is far, far smaller than Paoli, so they would logically have different levels of work and funding associated with them, and probably very different timelines.

The Paoli project is moving forward. I am told that both Tredyffrin Township and SEPTA are preparing separate RFPs for road way design needed for the transportation center this summer. Precise timelines, however, are not available. That there is work being done, and the funding needed for that work exists, are good signs in my view.

In response to your question about the status of the Paoli Transportation Center, the following is the most recent update:

Both Tredyffrin Township and Septa are about to issue Requests for Proposals for transit and road improvements. all of the work will be grant funded, mostly from federal funds.

SEPTA’s RFP will be for design of the new station and parking garages. Tredyffrin is issuing 2 RFPs : one to lead the public input process and design road improvements associated with the Paoli Transportation Center; and the other for the design of the improvements recommended by the recent feasibility study for the Rt 252/30 intersection. The Township told me that once the RFPs are ready to go out they will be posted on the Township website, along with a project update.

We are assured by Township and County representatives that Paoli remains a top transportation priority for Chester County. It continues to have the support of Federal and State representatives.

Please make a brief statement on the Paoli Transportation Center project. In 200 words or less, please offer your opinion on why the project has lagged for 15+ years, if there is a future for the project and whether or not you support the project. If you support the Paoli Transportation Center project, as a supervisor, what would you do to ensure that it is a priority of the state’s Department of Transportation and receives adequate funding.

I fully support a new Paoli Transportation Center, built in a way that improves the quality of life of our community and fully protects the interests of Tredyffrin residents. This project is a top local transportation priority for our federal and state legislators, the DVRPC, PennDOT, SEPTA and Amtrak.

As a current Supervisor, I have participated in recent planning discussions and at our upcoming meetings the Tredyffrin BOS will consider two Requests for Proposals: 1) a public input process to assure that our community’s voices are heard and 2) design of local road improvements in the Paoli community, including the 30/252 intersection. Also, SEPTA is preparing a RFP for the design of the new station and parking garages.

It is frustrating to see how slowly the Paoli project is taking, but it is significantly more complicated than a “simple” regional rail station relocation. The Paoli project is a public/private development on a former superfund site, which required clean-up, a zoning change in two municipalities, awarding of a contract to a private developer, coordination of two transit agencies (Amtrak and Septa), and juggling of various public funding sources. We have actually made a huge amount of progress on this complex process, but the devil is in the details and that is where we are — waiting for formal submission of plans from the developer and the transit agencies. That said, I believe that at least in Tredyffrin, there have been a number of individuals, some elected, some not, who have been advocates for the Paoli project over the years and have given endless hours of their time to help move the process forward. What I think we have lacked is a united Board of Supervisors in support and as advocates of the project, without which the need for the project probably seems less urgent at the state and federal levels. My goal as Supervisor would be to work to create that united front.

Paoli has the potential to be a jewel in Tredyffrin. As someone who uses the Paoli station for travel to Philadelphia and New York and who lives near the station, I strongly support and will advocate for the Paoli train station redevelopment project.

The infrastructure of the station is outdated and dilapidated. The roads around the station are unsafe and gridlocked. Lack of parking is a significant contributing cause of failed local businesses. Tredyffrin has lost out to neighboring townships in attracting new businesses because of the limited usefulness and overall undesirability of the Paoli station. We cannot afford to continue to do so. Exactly why the project has lagged is not as important at this juncture as recognizing the progress made in the last few years and keeping the pressure on to advance the project. Tredyffrin has a unique opportunity to transform a run-down station into a vibrant, smart growth transportation center. Intelligent redevelopment of the Paoli Rail Yard will encourage economic development in the Township, improve local traffic problems, alleviate congestion on local roads and encourage rail travel.

This project is going to happen. Tredyffrin and SEPTA have already put the wheels in motion for transit, station, parking and area road improvements, using mostly federal grants. I have existing relationships with the Township and State leaders who are active participants in the reinvigoration of this project. As Supervisor, I will ask to be a member of the Township’s Task Force, making it one of my top priorities.

Tredyffrin’s Opportunity. Some might offer the following reasons for the more than fifteen year tortuous path of the Paoli Transportation Center (Center)—complicated project, numerous governmental and private stakeholders, burdensome procedures, environmental issues, money, developers, and two townships. I say that this project has suffered from a lack of political will and vision. The Tredyffrin community would have long been enjoying a completed Center and a vibrant Paoli if Tredyffrin’s governmental leaders had vigorously pursued this important project with vision and leadership.

I fully support the completion of the Paoli Transportation Center. This project creates jobs, short term and long term. The Center will revitalize Paoli. It will help make Paoli a vibrant town center in and for our Tredyffrin community. The new Paoli will mean an expanded tax base for the Township.

If elected, I will fight for the completion of the Paoli Transportation Center. I will work with my fellow supervisors to present a united front in Harrisburg in the pursuit of project priority and funding. I will lobby legislators and other governmental officials, alone and with other stakeholders, relentlessly seeking our rightful share of funds. We must seize this opportunity for our Tredyffrin community.

I hope that this offers some perspective on where the Paoli Transportation Center project stands with our elected officials and an indication from supervisor candidates as to what they would do to help the process, should they be elected. Also, it is my understanding that there will be an official update on the Paoli Transportation Center project at Monday’s Board of Supervisors meeting. Looks like progress and forward movement on the project may be coming this way . . . .

This budget recognizes the financial burdens we’ve placed on our families and reverses these trends by reducing spending and rejecting tax increases when people can least afford them.

I also knew we could do a better job prioritizing spending than the governor did in his proposal, and we have. Local schools will receive millions of dollars more than proposed. For example, we were able to restore $1.276 million to the Tredyffrin-Easttown School District alone.

Once a State Rep Campaign Debate, Could the Tolling of Rt. 422 be a ‘Model’ for Tolling Highways across the State?

What’s the saying, ‘What Goes Around, Comes Around” . . . ?

For most of the year 2010, voters of Tredyffrin Township had a front row seat as the ‘tolling of Rt. 422’ issue became a political football in the PA State House 157 race between incumbent State Rep Paul Drucker (D) and challenger Warren Kampf (R). Some political insiders might even argue that Drucker’s stance on 422 tolling may have contributed to the loss of his state representative position last November.

Although a heated campaign issue, post-election the tolling of Rt. 422 has had nearly non-existent discussion. That is until now. According to Pennsylvania Independent, an on-line news service, the 25-mile, four-lane US Route 422 will be promoted on Monday, June 6 as a potential ‘model’ for tolling highways across the state as a means to increase transportation funding.

Gov. Corbett’s recently appointed 30-member Transportation Funding Commission will hear a presentation on how tolls would work on Rt. 422 in Montgomery, Chester and Berks counties. The executive commission is looking at a way to generate at least $2.5 billion in annual transportation funding for infrastructure needs and the ‘tolling of 422’ may serve as the state’s model for how to do it.

According to Barry Schoch, Secretary of Transportation for Pennsylvania and chairman of the commission, “Route 422 model would allow county or municipal authorities to form a ‘local taxation authority’ and keep the revenue from tolls and local taxes dedicated for local highways”.

Construction of a local suburban commuter rail line was one of the possible uses of 422 tolls and a means to alleviate some of the highway traffic. If you recall, the Philadelphia-based Delaware Valley Regional Planning Commission (DVRPC) created a Route 422 Corridor Master Plan and presented their findings in 2010 to local municipalities, including Tredyffrin Township. Their plan, among other things, provided for a light rail commuter service and suggested tolling on Rt. 422 as a way of financing the project.

During 2010, the tolling of 422 provided a major talking point for the Drucker and Kampf political campaigns. Drucker supported DVRPC and the Route 422 Corridor Master Plan, which included tolling of 422. However, Drucker was specific that the tolling was for the commuter who was traveling the entire stretch of the highway on a regular basis, not the occasional user or those that would use it on-off.

In response to Drucker, Kampf’s opposing position on the Route 422 Corridor Master Plan was simple. On his campaign website, Kampf stated “My position on tolling Route 422 is clear: I oppose it.” Remaining true to his campaign words, when asked to respond to the upcoming Transportation Funding Commission presentation to use tolling of 422 as a model for the state, Kampf said, “Tolling is another way of taxing people. . .” He is opposed to using state and local funds to build, operate and maintain a commuter rail line that would benefit rail commuters at the expense of others.

Like much of the country, many of Pennsylvania’s roads and bridges are in crisis; desperately in need of repairs. Although lawmakers on both sides of the aisle agree on the infrastructure needs, they may not be as unified in the funding solutions. No one has a crystal ball, but we now see evidence from Corbett’s Transportation Funding Commission that supports Drucker’s vision for the future . . . a suburban commuter rail line and the use of tolls to finance infrastructure improvements.

Some could argue that State Rep Kampf battled former State Rep Drucker successfully on the 422 tolling issue, but it looks like Kampf could face a far greater challenge in Harrisburg . . . and, from both sides.

Heaberg Claims Victory in Special Election but Questions Remain For Chester County Voter Services

Late last night I received a press release from Mike Heaberg (see below) that declares his victory in the Special Election.

Both political parties appear to be satisfied with the special election ballot hand counting on Monday by Chester County Department of Voter Services. The recounting process uncovered 61 ballots that were not originally counted, adding 52 additional votes to Republican Mike Heaberg and 9 additional votes to Democratic Molly Duffy totals. The original vote count had favored Duffy by 40 votes, but with the additional votes, the final vote count was Duffy, 2,275 votes and Heaberg, 2,278; a difference of only 3 votes, in favor of Heaberg.

We now know that all 61 ballots belonged to registered Republican voters, leading to many questions. It is understood that the actual ballots of the Republican, Democratic and Independent voters are printed differently. The only thing that makes any sense is that there appears the problem may have been a printing or alignment issues on the Republican voter’s ballots. I have also learned that the problem was not at only 12 of the 17 precincts as I previously wrote, but actually occurred at virtually every precinct.

Therefore, if we assume that there were mechanical issues with Republican ballots, printing or otherwise, I still find myself struggling with several issues and maybe someone can help me. After the polls closed on election day, I assume that there is a certain procedure that takes place, i.e. tallying the votes, posting the results at the precincts, delivery of materials to Voter Services, etc. As part of this procedure, each precinct must have an individual responsible for ‘signing-off’ on the accuracy of the vote count, correct? So did these individuals sign-off on the results? Did they report the inaccuracies to Voter Services when they delivered the materials that evening? I am curious how the actual procedure works — maybe Steve Shapiro as Judge of Elections for W-2 precinct could help us understand the procedure.

I understand that Voter Services was aware made aware of various issues, including malfunctioning machines, during the course of Election Day. If Voter Services knew there were problems and that the vote count was inaccurate, why would they bother to post the precinct vote count and the final totals on their website? Would it not be more appropriate for them to make a statement concerning the problem and that they were working to correct the discrepancies?

The issues surrounding the special election – the malfunctioning voting machines, the uncounted 61 votes, inaccurate reporting of ballot results, etc. are unsettling and troubling; and I look to Voter Services for answers and accountability. Not only about what exactly went wrong but also how they intend to correct these problems in advance of the general election in November. At a minimum, I suggest an internal examination of Voter Service procedures. Should the County Commissioners investigate?

Tredyffrin Supervisor Michael Heaberg today released the following statement regarding the results of the Special Election held on Tuesday, May 17th:

“In light of the hand count of all votes in this race by Chester County Voter Services in the presence of representatives from both campaigns, and with the results of that count showing my campaign to have won, I want to thank the voters of Tredyffrin for their support and all of the people who worked so hard in this campaign to make this victory a reality.”

“I look forward to representing the concerns of all Tredyffrin residents and addressing issues of importance to all, just as I have as an interim Supervisor. I ran on a platform of continuing fiscally responsible government that meets the needs of residents and protects our quality of life, and I am grateful for the opportunity to serve and continue a successful track-record for the people of Tredyffrin.”

“While the special election is now over, I look forward to continuing to meet with and talk to the people of Tredyffrin as I seek their support for a full term as Supervisor.”

“I also wish to join with the leaders of the Democratic Party of Tredyffrin who expressed their confidence in Voter Services’ ability to come to an accurate and reliable tabulation. I thank the professionals there who took the time to investigate reports of voting machine issues on election day and put in the effort to ensure a result in which all residents can have confidence.”

Hand-Count of Duffy-Heaberg Special Election Ballots in Tredyffrin Finds 61 Uncounted Ballots . . . Changes the Outcome of the Race

A week ago the polls closed, the votes were counted and unofficially Democrat Molly Duffy had won the Special Election against Republican Mike Heaberg by 40 votes. Chester County Department of Voter Services listed unofficially Duffy receiving 2,266 votes and Heaberg with 2,226 votes.

Immediately following the closing of the polls, there was discussion of voting inaccuracies and talk of machine malfunctions. We learned first hand from Steve Shapiro, the Judge of Elections at the W-2 precinct, that there were an additional 5 ballots found in the voting machine that were not counted. There were reports of similar malfunctioning machines at four or five other precincts in the township. As a result, Chester County Voter Services conducted a daylong hand-count yesterday of all 17 voting precincts in Tredyffrin. Duffy and Heaberg attended the recounting by Voter Services, as did their attorneys and representatives from the Tredyffrin Township Democratic and Republican parties.

Late yesterday, after recounting all the ballots by hand, it was determined that 61 ballots were not originally counted, changing the results of the special election. Of the 61 ballots found not counted, nine additional votes went to Duffy and 52 additional votes went to Heaberg. The new unofficial vote total indicates Duffy receiving 2,275 and Heaberg receiving 2,278 . . . a difference of 3 votes, this time in favor of Heaberg. If this total is accurate, it may be the closest supervisor election in the township’s history.

It is my understanding that there was vote count issues found in 12 of the 17 precincts. How is this possible? That strikes me as a very high percentage of malfunctioning machines! However, at this point, it is unclear to me if the problems were attributable only to machine malfunctions or if there were other types of errors. Who could have predicted that a 40-vote difference in favor of one candidate could change with a recount to favor the other candidate by 3 votes? What is the probability of that happening?

Again, there is caution that the new special election vote totals are unofficial until certified. Do we believe that the hand-count is accurate and that this final vote count will stand? Or, will it take 4-5 weeks as previously explained, for the certification process? Assuming the new hand-count number is correct; will the Democrats challenge the election results?

For me, I’m still stuck on how 61 ballots went uncounted . . . and how many times in past elections has this same scenario played out but may have gone unchecked? It really makes one wonder.

Bottom line, until there is official confirmation on the special election results, I guess we just need to stay tuned.

Although the Dark End of the World Predictions Failed, There’s Light for Tredyffrin’s Special Election

If you are reading this, the end of the world predictions failed to pan out for Harold Camping. The religious broadcaster made the world’s biggest mistake, twice. Camping got the date wrong in 1994 when he said the world would end that year, and later explained its continued existence by saying he had made a mathematical error.

However, the May 21, 2011 prediction was different; Camping and his followers lavishly spent more than $100 million on billboards and radio advertising. Now Camping is left shaking his head, bewildered, that things did not go according to his prediction and the world did not end at 6 PM on May 21. With no Plan B in place, Camping may be forced to find some obscure, overlooked translation or an error in his math and then move the apocalypse date to a new date.

To follow up on last week’s special election in Tredyffrin, by the time you read this, there may be further news. It is my understanding that at 9 AM this morning (Monday), the two at-large supervisor candidates, Democrat Molly Duffy and Republican Mike Heaberg are meeting with Chester County voter service representatives. (The special election determined who would fill the vacated seat of Warren Kampf until January 2012). Also in attendance for the voter services meeting will be a representative from the local Democratic and Republican parties. Additionally, Duffy and Heaberg will each have an attorney present. Voter services will be conducting a hand count of the votes from the special election with Duffy, Heaberg and others in attendance.

I am not clear if voter services is hand counting the votes from all 17 precincts or only the precincts where is evidence of voting machine malfunctions. As it now stands, the unofficial vote count from last week’s special election indicates 2,266 votes for Duffy and 2,226 votes for Heaberg, a difference of 40 votes. The public needs to know that the total count in the special election is accurate and that all votes were counted, but . . . we as a community need to get to the other side of this issue and accept he voter services hand counting today.

Tonight is the Board of Supervisors meeting . . . will supervisor Heaberg remain on the dais as a member of the Board of Supervisors or, if the hand count with voter services supports the unofficial results that Duffy is the winner, will she take her seat as a supervisor? Originally, all indications were that the official results from the special election would be official and certified in 4-6 weeks. However, the special election hand counting is taking precedent over voter services handling of the primary election results; perhaps there will be an official vote count released today. Stay tuned.

The Cost of a Ballot Challenge in Tredyffrin Township . . . $2,614.60 plus posting a bond fee

The closeness of the election results, coupled with reports of voting machine malfunctions, has led to speculation about a possible vote recount in the Duffy-Heaberg special election. As reported on the Chester County’s Department of Voter Services website, the unofficial election results indicate that Democrat Molly Duffy received 2,266 votes and Republican Mike Heaberg received 2,226 votes.

I have received several notices stating that the Republicans were challenging the election results of the special election and calling for a vote recount so . . . I did some investigating in hopes of better understanding the process. First off, I called the Chester County Department of Voter Services. As of 3:30 PM today, Thursday, there has been no ballot challenge petition received for the special election or any other race in Tredyffrin Township. Further, as was explained to me by a voter service staffer, it would be unlikely that such a petition would be received at this point in the election certification process. Why? Here’s what I learned from a Chester County’s voter service staff member on the certification process.

The voter service ‘computation committee’ will meet for the first time tomorrow (Friday) to begin work on the 2011 Primary Election certification process. This committee will take 2-3 days to sort through all the paperwork from the 226 voting precincts in the county (Tredyffrin Township has 17 voting precincts). After sorting the paperwork, the committee begins with write-ins, absentee votes and reconciliation of ballots from each precinct in the county. To complete the certification process will take the computation committee 4-6 weeks. According to the voter services representative, it would be unlikely that someone would challenge the vote count until the certification process is completed. It would appear that a candidate should wait until the election results are certified and pronounced official. I asked if the reported malfunction voting machines would pose an additional time delay and the response was not likely.

Curious, I asked if there was such a thing as an ‘automatic’ recount of votes if the certification process indicated that a race was very close, say just a few votes separating the candidates. The answer was no; there is no automatic recount; regardless of how close the election results.

Next question, how much does it cost to petition for an election recount? I discovered that Chester County Department of Voter Services does not handle the money side of a ballot challenge and I was referred to the Chester County Prothonotary’s Office. I called the Prothonotary’s Office and spoke to Elizabeth Doan, First Deputy. Deputy Doan explained that the fee schedule for a ballot challenge is $153.80 per precinct. Since the Duffy-Heaberg special election was for an at-large township seat, the petition charge is $153.80 for each of Tredyffrin’s 17 precincts or a total cost of $2,614.60. Additionally, there is a bond fee of $50, which the applicant would need to petition to have returned. It was unclear if the $50 bond fee was per precinct or a one-time fee; Doan suggested that I contact an attorney for clarification.

What did I learn from this exercise? It would not appear to make sense to petition for a ballot challenge until after Chester County Department of Voter Services completes its certification process. The computation committee has to first complete their certifying process before they can do a recount and that would be 4-6 weeks from this point. I was cautioned throughout my conversation with voter service staff that the election result numbers on county website are unofficial until they are certified.

I hope that this clarifies the ballot challenge process and offers a timeline for the election results certification and the cost of a petition process in Chester County.

Light at the End of the Tunnel for Tredyffrin’s Special Election Candidates – Your Vote Counts!

There is light at the end of the tunnel for Republican Mike Heaberg and Democrat Molly Duffy, Tredyffrin’s special election supervisor candidates. Monday, May 16 will be the last full campaign day before the special election and primary election the following day. Appointed interim township supervisor on February 7, Heaberg faces opposition from Duffy in the special election . . . they will take their case to the voters on Tuesday, May 17. Vying to fill the open Board of Supervisors seat left vacant by State Rep Warren Kampf, Heaberg and Duffy have spent much time at people’s doors in the community, asking for support and hoping to garner a commitment of a vote.

Historically local voter turnout for the primary election is dismal; but maybe the prospect of choosing a supervisor in the special election will attract more voters this year. For us registered Independents, primary elections come and go in Pennsylvania, always without us . . . sadly we do not get to vote in primaries. Pennsylvania is one of 18 states where Independent voters cannot vote in primary elections; I have often-thought that closed primaries disenfranchise a significant number of the American people.

So although we must leave it to our Republican and Democratic friends to vote in Tuesday’s primary election, the Independents can make our voice heard in the supervisor selection process in the special election. Yes, all registered Independent voters, your vote will count in the Heaberg-Duffy special election race. Although we only get one vote on Tuesday, it is an important vote nonetheless . . . your can help decide who will serve our community as an at-large supervisor until January 2012. Regardless of who merges victorious on Tuesday, Heaberg and Duffy will both appear on the November general election ballot for a full 4-year term.

For registered Democratic and Republican voters, you too can vote in the special election but, additionally you can vote in the primary election for supervisor, school board and magisterial district court judge candidates.

The polls will be open for the special and primary election from 7 AM – 8 PM. Below are all our local candidates that will appear on Tuesday’s ballot.

Moving On . . . Is Partisan Politics in Local Elections our New Reality?

This week’s torment from my stance on Community Matters (and its use) came with a personal price tag. I watched helplessly as something that I created and nurtured over the past eighteen months became a political football. Rather than feeling good about taking a stand for justice for Community Matters, and myself, I became the target; my words twisted and misinterpreted. In the words of William Shakespeare, “This above all; to thine own self be true”. That mantra proved particularly difficult to follow this week. Through the sadness and disappointment in some people, I learned some difficult life lessons . . . but, I also learned the meaning of true friendship.

In addition to Primary Election Day on Tuesday, May 17, it is the Special Election to decide which supervisor candidate, Molly Duffy or Mike Heaberg, will fill the unexpired Tredyffrin Township supervisor term left vacant by Warren Kampf’s election to State Representative. Tomorrow I plan to list the special election candidates, school board, board of supervisor and municipal judge candidates. I will make available his or her resumes and encourage everyone to get out and vote.

Based particularly on this week’s events, I offer some remarks on the new reality of partisan politics in local elections. Why are candidates for local office forced to play party politics in order to have a viable candidacy? Why can’t they just run as themselves? Whatever happened to “vote for the person, not the party?”

In my perfect world, municipal politics would be free of partisan interests. Those individuals elected to serve, would do so for all the community. The interests of the people would always trump the political party the elected official represents. In my perfect political world. There are, of course, no perfect political worlds, and Tredyffrin Township is no different from the rest.

Politics has the ability to bring out either the good or the bad in mankind. The human desire for power, if unchecked, is evil. Evil partisanship can destroy the fabric of a local community.

Perhaps more appropriate than the label of ‘Independent’, I guess I would call myself an ‘Idealist’. As an idealist, I lament for a future of local nonpartisan elections, where there will victoriously emerge individuals whose intelligence, integrity, intestinal fortitude, character and non-alliance with special interests are beyond question. I wish for a future where important issues and candidate differences can be fairly discussed and openly debated.

In the end, voters will elect whomever they think will do the best job — or at least that’s how they should cast their ballots. But what’s often said about democracy? Despite its obvious faults, it’s the best system of governing. The people, the voters, get to decide who governs them. That will be the final word on partisan politics in local elections, and local government.
