What would General George Washington think about casino gambling in his backyard?

I drove through Valley Forge National Historic Park, enjoying the weather and the beautiful autumn colors of the trees. I was remembering General Washington and his Continental Army from 1777-78 as I exited the park onto Gulph Road by Rt. 422. With thoughts of the Revolutionary War in my mind, I turned the corner to see construction signs for the Valley Forge Casino Resort.

At a cost of $100 million, the new resort casino is scheduled to open in the spring of 2012. Apparently, the casino will create 500 permanent jobs and is expected to add many tourist and business dollars to the local coffers. Advertised as ‘world-class’, the casino will be housed in the Valley Forge Convention Center and feature 50 table games and 600 of the ‘most popular’ slot machines. Construction is currently underway to convert 40,000 square feet of the convention center into the casino.

By spring, our tourist and business travelers can tour Valley Forge National Historic Park, shop at the King of Prussia Mall and gamble at the casino resort. The architect for the project is Cope Linder Architects who designed the Borgata in Atlantic City. The architects will create a gaming space with high ceilings and design with feng-shui influence – sorry, not even this planned high-style design is selling me.

I have not heard any mention of infrastructure improvements as a result of the casino. My guess is that because the owners of the Valley Forge Convention Center are utilizing the existing footprint, additional improvements for road and traffic issues may not be a requirement for the land development project. So maybe it is incorrect of me to suggest that the planned resort casino will add to the existing traffic problems of Routes 23, 422 and 202 in the King of Prussia area. Maybe a casino will not add any more cars on the road than the convention center.

I saw an advertisement in the Pottstown Mercury newspaper that caused me pause. If you are a local college student that is looking for a new career path, apparently the Montgomery County Community College has partnered with the Valley Forge Casino Resort to train potential job candidates in the art of ‘card dealing’. Although employment at the casino is not guaranteed, the college course will teach you everything you need to know to become a dealer in the exciting casino world. Guess the saying, “if you play your cards right” has real meaning in this case! The country’s economy and lack of jobs coupled with promises of a lucrative, exciting life will probably encourage some of our Pennsylvania college age kids in the direction of casinos as a career path.

Bottom line for me . . . something just seems so wrong about a glitzy resort casino juxtaposed to the Valley Forge National Historic Park. I accept that many jobs will be created and additional revenue will help the local economy but I don’t think anyone can argue that a resort casino will forever change our landscape. I am not a gambler so maybe that is the major reason that I am saddened by this local construction project. I would be curious to know what others think of a casino in our backyard.

Tax Study Group to Present EIT Findings . . . Will Yellow Signs by Republican Candidates Influence Residents?

As part of the budget process for the T/E School District, a Tax Study Group composed of community volunteers was formed to determine the impact of an earned income tax (EIT) on residents and the school district. The goal of the group was to identify the pros and cons of an EIT for residents and then present their findings in a public presentation to the community. The Tax Study Group will offer its findings on Thursday, November 3 at 1 PM at the T/E Administration office, 940 W. Valley Rd, Suite 1700, Wayne and again at 7 PM at the Valley Forge Middle School, 105 W. Walker Road, Wayne. Please plan to attend so that you can make an informed decision on EIT (in the event it is on the Primary Election ballot in April 2012.

I have expressed my disappointment that the Republican candidates (school board and supervisor) took an advance stand against an earned income tax prior to the presentation of the Tax Study Group. In fairness to the process, and to the volunteer’s time of those serving on the study group, why not wait until after the presentation of the EIT before publicly declaring that you are against it. The severity of our school district’s economic situation requires that all options be explored – the presentation by the Tax Study Group on the earned income tax is one of those options.

An ‘As I See It’ article written by John Petersen, resident of Paoli appeared in the Main Line Suburban newspaper a couple of weeks ago. The article was written shortly after the first bright yellow, ‘no EIT’ signs began appearing in the township. Because the article was not included on Main Line Media’s online site, I could not provide a link on Community Matters.

As I See It: Those little yellow GOP signs: proof the GOP does not respect you

If you have been driving around Tredyffrin (since this is not a walking township), you may have noticed a new type of yellow growth sprouting up all over the place. Naturalists have classified it as Fungi Reipublicae. In fact, these yellow growths are actually a new version of the yellow GOP signs that we saw in 2007. These signs come in two flavors: “No Earned Income Tax” and “Top Ranked Schools.” Both cite that you should “Vote Republican”. Let’s break down the claims.

No Earned Income Tax

This sign would have you think that there is an active question in front of the voters and that if you vote Republican, you will be saved from the evils of an Earned Income Tax. Let’s set aside the fact that many already pay an EIT for a moment and instead, concentrate on the straw man argument that Tredyffrin GOP is perpetuating. In fact, there is an earned income tax study committee that has been commissioned by the school board. That committee was first suggested by Republican school board member Kevin Mahoney. To review, there is no active tax question in front of the voters and the only group that is studying the feasibility of an EIT in Tredyffrin was suggested by a Republican.

Top Ranked Schools

It’s true, T/E Schools are quite good. The Tredyffrin Republican Committee would have you believe that Republicans, and Republicans alone are responsible for our “top ranked schools.” In fact, there are a number of Democrats on the school board. I guess they have nothing to do with the successes. Fine, let’s give all the credit to the Republicans. But if we do that, let’s examine the whole cloth. Of Lower Merion, Radnor and T/E, is T/E the best? In terms of facilities, absolutely not. While T/E has retrofitted old buildings, both Lower Merion and Radnor have made a commitment to invest in infrastructure, the type that is required for children to get a top-notch public education in the 21st century. As for test scores, college acceptance, etc – Lower Merion and Radnor are at least as good as T/E.

How about labor relations? T/E is definitely not at the top of the class there? How about fiscal responsibility? T/E is about 9 Million in the hole. You know all of the sweetheart deals for teachers the Republicans are complaining about? Guess what, it’s the Republican led school board that has consistently given the unions what they wanted. At the same time, they are not keen on paying for it. Those same Republicans have consistently raised our property taxes year after year. And yet they are the same people who claim to be protecting us from the evils of an earned income tax.

Any organization that would try and sell the political rhetoric that we see in these yellow signs clearly does not respect their customer. The Republicans believe that we are all too stupid and too quick to fall into the fear trap. The Republicans are banking on the fact that we will believe the scare tactics that the other side is just out to tax and spend our money. Seems to me, the Tredyffrin Republicans have done a good job of that on their own already. They don’t need help from anybody! And never forget, the Tredyffrin Republicans is the party of Bob Lamina, and Paul Olson. If that is not enough reason to give the Tredyffrin Republicans a vote of no confidence, I don’t know what is.

Tredyffrin Supervisor and School Board Candidates Do Not Participate but Easttown School Board Candidates Do!

With the countdown underway to the General Election on Tuesday, November 8, I sent an email about a week ago to Tredyffrin Township supervisor candidates and to school board candidates for the Tredyffrin Easttown School District. My email to the candidates was simple; it contained a 3-part question asking the candidates to respond in 200 words or less to the following:

(1) In your opinion, what is the single most important issue facing Tredyffrin Township (or Tredyffrin Easttown School District)
(2) If you were elected, what would you do to help solve or improve this issue?
(3) Tredyffrin Township (or Tredyffrin Easttown School Board) needs problem-solvers; what in your background or job experience qualifies you to help solve this important issue?

In addition to posting their responses to the 3-part question, I offered to include the candidate’s resumes on Community Matters, as I did prior to May’s Primary Election. Believing that it is important for voters to make an informed decision on which candidate they elect to serve us, I saw no downside to the candidates participation in May nor did I at this time.

Much to my surprise, the individual Tredyffrin Republican supervisor and school board candidates declined my offer, suggesting that voters could visit their websites for information and that, “We are more than happy to answer questions from individual voters across Tredyffrin – and are doing so while going door-to-door, attending community events, and more.”

Although my email offer was sent directly to the individual candidates, it was the chair of Tredyffrin Township’s Democratic Party, Dariel Jamieson that responded on behalf of the Democrat supervisor and school board candidates. Dariel’s email on behalf of the candidates, likewise declined the offer to participate but the decision was for a different reason,

“Our BOS and School Board candidates prefer not to submit answers to the questions you posed to them until after the LWV [League of Women Voter] debates. The questions were all ones that were asked in the debates two years ago – as they should have been, they are key questions – but to have our answers published first is not fair to the LWV and makes the job of our candidates harder to distinguish themselves in the debates.

Dariel also suggested that voters could visit the website of the candidates. She apparently does not want the Democratic supervisor and school board candidates to ‘show their cards’ in advance of the debates next week.

I’d be more likely to buy that explanation were it not for a lengthy editorial written by Democrat at-large supervisor candidate Murph Wysocki that appeared in last week’s edition of the Main Line Suburban newspaper, Main Line Media News online and TE Patch online. His editorial describes his background and skill set and what he views are the important issues facing the township; in essence, answering the 3-part question that I posed. This week I see that Democrat supervisor candidates Molly Duffy and Tory Snyder have a joint letter to the editor in the paper in the Main Line Media News. In other words, Dariel’s logic of not wanting to ‘let the cat out of the bag‘ pre-debate is lost on me.

To be fair, I do not know if the Democrat candidates weighed in on this decision or not. In the case of the Republicans, their email was signed by the candidates. As full disclosure, Dariel did offer that the candidates could answer my 3-part question after the debate. I believed that this was a win-win opportunity for candidates (and more importantly, the voters) to respond.

My sole purpose in sending the request to the supervisor and school board candidates was to offer voters an additional resource to ‘know the candidates’ before Election Day — believing that the more informed the voter, the better choice he or she will make. I also saw this as one more opportunity for voters to review the resumes of the candidates before voting.

I want to see our community elect independent-thinking problem solvers and viewed that this exercise could encourage voter turnout on Election Day!

You notice that I talk about the Tredyffrin school board candidates; not the Easttown school board candidates. Easttown resident and TE School Board encumbent Pete Motel (R) is being challenged by Easttown resident Craig Lewis (D).

Because our school district is made of school board members from Tredyffrin and Easttown Townships, I had sent Motel and Lewis the same email with the 3-part question. Motel and Lewis were appreciative of my offer to help inform the voters and have chosen to participate. For the record, Motel and Lewis will also be participating in next week’s school board debates alongside the Tredyffrin school board candidates.

When I sent my emails to the supervisor and school board candidates, I stated I would post their responses in the order they were returned. Therefore, Pete Motel’s response is first, followed by Craig Lewis’ response. Their resumes follow their responses. Although I cannot vote for either Motel or Lewis for school board, I thank them for their participation and understanding the importance of informing voters on the candidates.

Pete Motel (R) — Easttown Township School Board Candidate

The biggest challenge facing the T/E School District is maintaining the quality of education it delivers during the current economic downturn.

District revenue is down by millions of dollars primarily due to two reasons:

1) Property tax assessment appeals resulting in decreased real estate tax collection;

2) Decreased home sales resulting in decreased real estate transfer tax. This is coupled with steep increases in the state required contribution to the state pension system – now millions above the contribution required last year.

Great efforts have been made by the Board to balance the District’s budgets without significantly effecting educational opportunities. The Board has implemented cost containment through administrative salary freezes, implementation of self-insured health insurance and more efficient scheduling of staff time.

With the economic recovery projected to take another several years, T/E Boards need to continue to cut expenses without reducing core educational programs. Success will require detailed knowledge of District operations and proven leadership skills.

My experience on the T/E Board as Committee Chairs and past Board president, coupled with my professional experience as a small business owner, demonstrate that I have the proven skills to help guide the District through the next few years of difficult budgets.

Craig Lewis (D) — Easttown Township School Board Candidate

TE’s biggest issue is irresponsible budgeting.

  • My opponent, republican Dr. Motel, has mandated 5 study halls per week in Conestoga High (12% instruction reduction) AND a 20% increase in students per teacher. TE was the 4th best high school in Pennsylvania. Losing this rank will result in a 10% home price decline, reduced college acceptance, scholarships and earning potential.
  • My opponent diverted education money to purchase, tear-down and build non-educational facilities wasting millions of dollars.

TE’s projection shows out-of-control budget shortfalls. Starting with the current year they are:

-$15,450,000

My fiscally conservative priorities to prevent this catastrophe are:

Stop wasteful spending

  • Halt all construction and real-estate acquisitions.
  • The teacher pay was cut and workload increased 20%. Aggressive cost reduction has to look at all other areas.
  • Halt no-bid contracting

Preserve our premier school ranking

  • Repeal the 5 study-hall mandate.
  • Respect our staff; balance their workloads.
  • Initiate summer enrichment programs for profit.

Retirees deserve school tax relief – My opponent never did this, I will.

I have twenty years of experience in setting goals, developing strategies, creating and managing budgets, both departmental and enterprise wide. This required creative approaches, engaging individuals from different departments to drive successful outcomes.

St. Davids Golf Club, Burned-out Light Bulbs & TE School District Finances!

I attended last night’ Board of Supervisors meeting and my friend, Ray Clarke attended the T/E School District’s Finance Meeting. Following my update on the supervisors meeting, please read Ray’s comments.

The agenda for last night’s supervisors meeting went quickly and there was no ‘new matters’ from board members. I was prepared for ‘new matters’ from citizens with two topics. Based on the supervisors meeting of October 3, I asked Supervisor Olson (Bob Lamina and EJ Richter were absent) if St. Davids Golf Club had been contacted. Olson deferred to Mimi Gleason who said yes, the club was contacted and said it was a positive conversation. I asked about the timeline for response from the club re the sidewalks and her response was that there was no time limit. In other words, I said the issue remains ‘open ended’ to which she responded yes. Bottom line, it may have taken us 21 months to get to this point in time with St. Davids Golf Club, but apparently nothing is going to move forward anytime soon, in the way of enforcement, etc.. Was the only way to receive an update (status) on the sidewalks at St. Davids was to ask the same question at every Board of Supervisors meeting? I guess that is correct.

Second citizen matter from me last night was the burned out light bulb situation in the township. Although I have focused on Chesterbrook and Duportail on Community Matters, I have noticed other area lights out (Old Eagle School Rd. as an example). My questions produced some interesting facts:

  1. The township (residents) pays PECO per light post, regardless if there are electrical issues or if the lights are working or not.
  2. The township has a yearly maintenance contract with Lenni Electrical to change light bulbs. Some have suggested that perhaps the township was trying to save money and maybe wasn’t calling the company for maintenance as a way to avoid service call expenses. Well, I discovered that the township (residents) pays a flat fee regardless of how many (or how few) times they come out to change the light bulbs!
  3. The pink ribbons are placed by township staff to indicate to Lenni Electrical where light bulbs need replacement. I noticed driving to the township building that there are pink ribbons on street lights that have working light bulbs and questioned why weren’t the ribbons removed when the light bulbs were changed? Obvious, I would think. According to Steve Burgo, township engineer, they know that this is a problem and are working with the contractor to get them to remove the pink ribbons.

Mimi cited ongoing electrical problems on Chesterbrook Boulevard as the cause for the non-working light bulbs. I suggested that the electrical problem with some of the Chesterbrook lights has existed for 27+ years. The response from Mimi Gleason, was that they were working with PECO and that State Rep Warren Kampf had been called for assistance.

After leaving the township building, I decided to do a more scientific study of counting the burned-out light bulbs on Chesterbrook and Duportail Rds. I drove down one side of Chesterbrook Blvd. to Valley Forge Road, turned around and drove back, counting as many of the burned-out light bulbs as I could find. This 2-mile (or less) stretch of roads doesn’t have 19 burned-out light bulbs, there are 37 non-working street lights.

Am I the only one who has a problem with this? We are all taxpayers and our money is paying PECO for these lights and our money is paying Lenni Electrical change the light bulbs. Where’s the accountability on this issue? I remain hopeful that at least one of our supervisors will take up the cause of township light bulbs.

Moving on to last night’s TE School District Finance Committee meeting. While I was busy sorting through the burned-out light bulb situation, Ray Clarke was at the Finance Committee meeting. He offers the following comments with his own editorial remarks. As always, I am appreciative that Ray not only attends the school board meetings, but takes the time to detail his thoughts for Community Matters. Thanks Ray!

The TESD Finance Committee meeting turned up a few points of interest on Monday night.

  1. The district’s 2010/11 financials got a nice boost from the decision to self-insure healthcare benefits coupled with better than projected claims experience. That turned out to be a $1.3 million favorable variance, which in turn generated a $0.9 million surplus for the year. So our Fund Balance, combined with an additional $0.5 million which under previous accounting rules was separate (I think), is (6/30/2011) now up to a munificent $31 million. (Note, I came in slightly late to this discussion, and there was no handout on this, so my numbers may not be precise)
  2. Also on the plus side, the Committee discussed what to do with the restoration of Corbett’s proposed cut to the state reimbursement of 50% of social security taxes, worth $1.3 million this year, which came in after TE’s 2011/12 budget was passed. The administration proposed ~$200K for postponed text-book buys and ~$300K mostly for technology spending. This generated a lot of debate, essentially asking the question: what is going to be the impact of, say, $60,000 for piloting applications for iPads, versus the current technology environment. To my mind this is the tip of a much bigger iceberg: how will we use technology spending to improve the analytic or creative skills of our students? If we need a pilot to answer that question, fine, but should we spend $60,000 for a pilot? It was agreed that this would be subject for future Board discussion.
  3. Important upcoming dates: November 3rd for the Tax Study Group’s presentation of the pros and cons of and EIT, and November 14thfor a special School Board meeting to consider notification of the intent to request a referendum on the April 24th ballot. Some important things (from my perspective) to bear in mind here:The official financial projection model is being modified to remove the assumption of a Act 1 index 1.7% property tax increase for 2012/13, so the base case is not both a property and an income tax. The base case gap for 2012/13 is currently $5.5 million. (It’s not clear that the model has been updated yet for the actual healthcare cost and fund balance outcomes.)
    1. The TSG’s approach is to present the features of an EIT independent of the alternatives; the Board (and potentially voters) will have to decide the merits of those pros and cons relative to its own assessment of the pros and cons of alternatives like cutting educational programs, raising property taxes or – for a few years – using some of that Fund Balance.
    2. Unknown actions of the townships, which would be entitled to claim up to 50% of the revenues from a voter-approved residential EIT, loom large. How highly would the BOS weigh education versus the township’s own needs?
    3. Of course, totally moot unless the School Board votes to ask the question, and the voters approve it, since there is no sign that the townships are mulling and EIT of their own.
    4. Of course, the Republican candidates for the School Board have already decided the EIT question for themselves without waiting for the TSG analysis. Presumably they are part of the minority in TE that a) does not pay the tax already, and b) has an income greater than 40% of the assessed value of their house, so would rather see any gap (after using some of that fund balance) made up from cuts in the education program or property tax increases.

On the TEEA contract: the district is required by the state to begin negotiations for the next contract in January. The way this all gets going is for the union to send a letter to the district at that time.

How creative can the parties be? Is there a way to trade-off much lower healthcare premiums/benefits (that encourage personal accountability) for maybe allowing step increases, keeping the total compensation cost within at the very least the increase modeled in the district’s current projection?

Tie a Yellow (Pink) Ribbon Round the Old Oak Tree (Light Pole)!

The tale of Tredyffrin’s burned out streetlights continues. Based on comments from several people on Community Matters, I started my mini-research project of non-working street lights in the township. As one person explained, the street light poles are marked with pink ribbons if they need new light bulbs. Sure enough, I see a number of street light poles on Chesterbrook Boulevard tied with bright pink ribbons. On Mill Road, at the entrance of the township building, there are three light poles right in a row with apparent burned-out light bulbs as they each have pink ribbons. Question . . . What is the time line for replacement light bulbs on those light poles adorned with ribbons? Don’t know. I also don’t know how long the ribbons have been on these poles.

Based on some of the comments on Community Matters, I assumed that the Public Works staff was the ones replacing the burned-out light bulbs. However, according to the township website, street light maintenance and repair is not handled in-house but is a contracted service. My guess is that the township staff marks the street poles with pink ribbons and then the outside company does the necessary light bulb changing. Again, not clear how long it takes to get a new light bulb after it is reported and the staff adds the pink ribbon. Residents can fill out an online township form (click here) with location details for light poles requiring new light bulbs or other maintenance issues.

Researching on the township website, I discovered that Tredyffrin owns and operates 1,824 lights. Who knew? The use of the word ‘owns’ may be accurate; but I think we need to address the ‘operating’ part. It is my understanding that PECO actually owns the light poles and the township pays a flat fee for the poles – and it appears that we pay by the pole, regardless if there is a working light bulb or not. There had been some discussion and I hope movement towards changing the regular light bulbs to LED bulbs. LED light bulbs have a higher front end cost than regular light bulbs but they last longer and are much more energy-efficient.

On November 15, 2007, Mimi Gleason presented the 2008 budget. Contained in the budget was the following information on streetlights:

A new initiative is proposed to begin upgrading streetlights to a more energy efficient medium. Most of the Township’s 1,900 streetlights are mercury vapor lights. The most energy efficient, long lasting street light available is a new LED light. Because the technology is new for streetlights, they are still very expensive. Estimates range from $1,000-$1,500 per light or roughly $2.5 – $3 million in total. In time, the cost should come down significantly. The proposed budget includes $50,000 this year to upgrade about 40 lights as a demonstration area to help promote further use of LED lights. With the Board’s approval, during 2008 staff will pursue a state grant to install a larger number of LED streetlights in 2009. From there, we would embark on a very long-term plan to eventually upgrade all of the lights.

Continuing my search for answers on the street light situation, I came across the August 12, 2008 Tredyffrin Township Municipal Authority Minutes with the following information included:

Mr. Norcini [former Public Works director] continued his discussion on the electric rate for streetlights. He said we purchased streetlights from PECO several years ago for cost effectiveness. Our rate is based on street light rates. We plan to install LED lights as a test this year.

Two meters will be installed – one to the existing streetlights and one to the LED lights. The meters should show how much electricity the LED light uses and how much our existing lights compare to what PECO says it uses. If the LED test project works and provides savings to us, we can determine a capital plan to replace the existing lights. We will be metering on Cassatt Road, and testing 14-15 new LED lights on North Valley Road from Central to Swedesford.

Fast forward to 2011 and next month the supervisors will be reviewing the proposed 2012 township budget. I for one will be looking at the line listing in the budget for street lighting and will be very curious to see its ‘expense’. In my research, I could not find the name of the company that holds the contract with the township on street lighting.

It is somewhat interesting to see where the township ‘was’ and where it is ‘now’ on the subject of light bulbs. I wonder what happened to the upgrading of the streetlights to LED plan in the township.

Gosh, at this point, I just want to see all the burned-out light bulbs prioritized (and replaced)! Seems to me that this discussion could also fall under the category of resident ‘safety’.

Sean Moir’s Animated Maps Brings the Battles of Paoli and Brandywine to Life!

At last week’s Trust lecture, Sean Moir, a GIS Analyst with Chester County, presented an animated map of the Revolutionary War troop movements in Chester County and Tredyffrin Township. Sean has worked for the last three years researching, mapping, and animating the conflicts of the 1777 Philadelphia Campaign, specifically the Battle of Brandywine and the Paoli Massacre.

His lecture for the Trust drew a standing-room only crowd to the Duportail House and his exciting presentation held the attention of everyone in attendance.

Sean’s award-winning mapping project is amazing and how he managed to bring to life the Revolutionary War battles of Paoli and Brandywine is remarkable. I feel privileged to live in one of the houses on a road that witnessed troop movement during that part of our country’s history.

With Sean’s approval, my husband Jeff videotaped the lecture and uploaded the 1 hr. and 19 min. presentation to You Tube for others to enjoy. Jeff noted that the video is best viewed if you select ‘full screen mode’ in You Tube. Jeff added the following comment when he emailed the link:

I thought that the anecdotal comments by Sean, including relating modern locations to the battlefield was great. I think this could be used as a great tool to teach people this part of history locally and nationwide.

Jeff is right – the mapping project and Sean’s lecture are important and should be included in the local history curriculum.

No Need for Written Request to St. Davids Golf Club to Build Sidewalks . . . Just a phone call! What happens if you get the answering machine!

I attended the Board of Supervisors meeting last night; primarily to see if the chapter on sidewalks (St. Davids) would finally be closed. Each time I think that we have turned that corner; there is a new twist that slows the process.

Whether in the audience or watching from home, the ‘Resolution to adopt the Green Routes Pedestrian Network map’ was not without debate. Chairman Bob Lamina stated that they would divide the township into 3 parts for discussion – essentially the east, middle and the western areas. A torturous process, discussion began with a ‘street by street’ review of the map, starting with the middle section and moving next to the western areas of the township.

The idea behind this resolution was to add a map to the new sidewalk ordinance passed at last month’s BOS meeting. However, the difficulty and confusion among the supervisors was whether the map was to ‘only’ include roads that would be affected by the newly passed sidewalk ordinance, which in essence were areas of the township where possible commercial development could occur. Or was the map to contain all suggested sidewalks, trails, etc. that were part of the green routes network as recommended by the special sidewalk subcommittee.

The debate on which sidewalks to include on the map heightened as the discussion moved to the eastern part of the township, specifically Conestoga and Upper Gulph Roads. Supervisor (Supervisor Olson suggested that sidewalks on Conestoga and Upper Gulph Roads be totally removed from the map.) By the time the supervisors were at the point of voting on the resolution, I am certain many of us were confused as to what exactly was to be included on this ‘Green Routes Pedestrian Network’ map. I believe that in the end, the supervisors voted 4-3 in favor of the map as presented by the sidewalk subcommittee. (Someone please correct me if I’m wrong). With much fanfare, Supervisors Richter, Olson and Lamina voted against the resolution. Richter used ‘storm water issues’ and ‘empty storefronts’ to explain her vote of opposition.

At this point in the meeting, with the map issue resolved, I expected that we would finally move past the sidewalk topic. However, no, much to the surprise of audience members (and some of the supervisors) Lamina made a new motion — for broader notification to the public when sidewalks were contained in future land development plans. There was concern from some audience members that this discussion was not on the agenda and needed further discussion. Supervisor John DiBuonaventuro questioned Lamina about the timing of the motion, suggesting that because the motion was formally written, that Lamina had sought legal counsel from the township solicitor in advance of the BOS meeting. Lamina explained that the idea had come to him at lunch, while “eating his bologna sandwich”! Supervisors DiBuonaventuro and Donahue voted against this motion, both believing further discussion was required. However, the motion did pass 5-2.

Surely, there could be nothing further to say on the topic of sidewalks in Tredyffrin Township. Not so fast. Stating that there was some ‘housecleaning’ needed, DiBuonaventuro offered a motion to remove the moratorium on the building of sidewalks at St. Davids Golf Club. The ‘hold’ dated back to the February 22, 2010 supervisors meeting. Now at this point, I was completely confused.

If you have been following Community Matters, you will note that after last month’s supervisors meeting, I sent a couple of emails to Mimi Gleason, our township manager (copied the BOS and Tom Hogan, township solicitor). I wanted to understand the next step in the St. Davids sidewalk saga and assumed that since the sidewalk ordinance had passed, the township staff now had the green light to move on enforcement of the sidewalks contained in any open land development agreements (including St. Davids). I had received the following response from Gleason, which I posted last week on Community Matters,

Before sending letters, the Township now will contact any of the property owners with approved plans that inquired about the need to install sidewalks. They will be informed that they no changes were made to the ordinance that changes anything for their plans. Enforcement proceedings will commence only if they refuse to install the sidewalks.

Based on Gleason’s email response to me, I was completely confused as to why DiBuonaventuro’s motion was necessary but OK; let’s tie up any loose ends.

However, the vote to move St. Davids Gold Club sidewalks along in the process did not come easily. Again, much discussion, primarily from Olson, who claimed that the township should take the $50,000 that St. Davids Golf Club, had offered not to build the sidewalks . . . further suggesting that St. Davids would instead give the $50K to the fire companies.

There was no way that I was going to let his remarks stand as anywhere close to accurate. For the public record last night, I stated that (1) St. Davids Golf Club had not offered to give $50K to the fire company and (2) there was never any written offer from St. Davids. The $50K ‘offer’ from St. Davids Golf Club not to build the sidewalks was contained in the 2009 BAWG report but was never substantiated! To perpetuate misinformation is simply wrong – bringing up the $50K offer from St. Davids was as if the township clock was turned back 20 months! Eventually DiBuonaventuro’s motion passed 6-1 (Olson the sole dissenting vote).

I then asked Gleason about the staff notification process to St. Davids re the sidewalks. Based on her earlier email to me, I was concerned and was of the opinion, that such a request to St. Davids Golf Club should be ‘in writing’. No, she explained, the staff would call St. Davids Golf Club and ask them to build the sidewalks. I said should not there be a paper trail of the notification – how does one track a phone call? Although she insisted that this was township procedure, I asked how was the public to know if the call was made. I suggested that no one could ever make a ‘right to know’ request over a telephone call. Bottom line . . . short of asking the question, “Did you phone St. Davids?” at every supervisors meeting, the public will not know. I asked what the timeline was for the phone call – I believe her response was, in the next 30 days.

It strikes me odd that after 20 months of St. Davids Golf Club sidewalk debate, the request for St. Davids to complete their 6-year-old land development agreement is not done in writing but with a phone call.

Wonder what happens if the township person calling St. Davids gets their answering machine . . . leave a message and assume that the right person gets it? Wow . . . is this really how local government works?

Do all Roads in Tredyffrin Lead to Sidewalks?

Although there was a 5-2 vote to approve the revised sidewalk ordinance at last week’s Board of Supervisors meeting, confusion over sidewalks still reigns. I think many would agree had there never been a BAWG report that suggested there was a $50,000 offer from St. Davids Golf Club not to build their ‘agreed upon’ and ‘contracted for’ sidewalks, we would not be where we are today. (To clarify, the $50K offer was not in writing and never substantiated).

For the last 21 months in Tredyffrin Township, it is as if all roads lead to sidewalks. The debate over whether St. Davids Golf Club would be required to build their contracted sidewalks has reigned supreme. A sidewalk subcommittee was formed and for over a year, held public hearings, received resident input, conducted surveys, etc. The results of the sidewalk subcommittee were presented earlier this year to the Board of Supervisors; indicating that the majority of the residents responding favored sidewalks, bike trails, etc. in the township.

The Board of Supervisors instructed the Planning Commission to draft a new sidewalk ordinance. After several months of discussion and review, the Planning Commissioners presented a sidewalk ordinance proposal to the Board of Supervisors. The supervisors agreed that the new sidewalk ordinance would have no bearing on the 8 currently open land development agreements that contained sidewalk requirements (including St. Davids Golf Club).

For those that attended the supervisors meeting or watched from home, the confusion over the sidewalk ordinance continued to reign supreme. Although the new ordinance passed 5-2, (Lamina and Olson the dissenting votes) there remains the open issue of the sidewalk ‘map’. The sidewalk ordinance passed but without a map indicating the sidewalk requirements. Discussion of the sidewalk map is apparently on the agenda for Monday’s supervisors meeting. However, there was some discussion from Lamina at the last supervisors meeting, that it may be his intention to go through the map, ‘road by road’ to decide the fate of sidewalks.

Wanting to understand the next step in the St. Davids Golf Club sidewalk saga, I sent a couple of emails to Mimi Gleason, our township manager. I assumed that since the sidewalk ordinance had passed, the township staff now had the green light to move on enforcement of the sidewalks in any open land development agreements (including St. Davids). I received the following email from Mimi:

Based on Gleason’s response, can we assume that by now St. Davids Golf Club has been contacted. I am not sure why there was an interim step ‘to contact’ vs sending the letter and will seek clarification. I will also ask what is timeline for a response before the enforcement letter is sent. After all the issues surrounding the sidewalks, I think it would be important to have a paper trail in place.

So . . . will St. Davids now build their required sidewalks? Or . . . will the country club wait it out, in hopes that their road will somehow disappear from the yet-to-be-approved township sidewalk map? Let’s hope that St. Davids will do what they contractually agreed to do. How long has it been – 5 or 6 years?

In a letter to the editor in this week’s Main Line Suburban, Tory Snyder, a Planning Commissioner and the chair of the special sidewalk subcommittee, gives an outline of the new sidewalk ordinance. As full disclosure, she indicates that she is a Board of Supervisors candidate in the East District. For folks that may not know, Snyder (D) is running against Paul Olson (R).

The following is excerpted from Snyder’s letter to the editor:

The facts of the newly adopted ordinance are as follows:

  • Sidewalks will be required on about 14 miles of Tredyffrin roads. The current ordinance requires sidewalks on all Tredyffrin roads.
  • All but one of the roads affected by the ordinance are major roads on which pedestrian safety is an issue. None of the roads are local roads per PennDOT or the Township Comprehensive Plan. Within the last two years a child walking along one of these roads with no sidewalks was hit by a car.
  • All roads affected by the ordinance provide needed pedestrian linkages to and from specific destinations, including schools, libraries, parks, train stations and shopping centers.
  • By nature of its location in the Subdivision and Land Development code, ONLY developers of non-residential and multi-unit residential properties would be required to build the sidewalks. Homeowners improving their own properties would not be subject to the sidewalk requirement.

This information lays out the facts and corrects some of the misleading and incorrect information that has been presented.

A planner by profession, Snyder further explains in her letter, “All 12 municipalities within a 25-mile radius of Tredyffrin require sidewalks in their subdivision and land-development codes. Almost all of these codes are stricter than the measured and balanced approach offered by the newly adopted ordinance. Were Tredyffrin to exclude a sidewalk requirement from its code, there would be no plan to add needed sidewalks in the future, and the entire cost of building any sidewalks would be transferred directly to the taxpayers.”

Stay tuned . . . the sidewalk saga continues at Monday’s Board of Supervisors meeting.

7th Annual Historic House Tour – A Success!

Many of you have asked me about last weekend’s House Tour. Thank you; the tour was a great success thanks to the homeowners, sponsors, guests and volunteers. I am hopeful that the following Letter to the Editor will appear in this week’s edition of the Main Line Media News.

The mission of the Tredyffrin Historic Preservation Trust is to help preserve and protect historic and cultural resources in Tredyffrin Township and to educate the public about the preservation and protection of historic and cultural settings. As President of the Trust and Chair of the Annual Historic House Tour, I would like to thank the special homeowners who opened their doors to Tredyffrin’s past for the 7th Annual Historic House Tour held this past Saturday, September 24.

What a truly delightful group of old house owners on this year’s tour – the effort and time spent on details by each homeowner was remarkable. Old house owners are very special people and this year’s House Tour participants were no exception. It is wonderful to live in a community that has people who cherish their historic properties and then allow others the opportunity to enjoy them!

As one of the Trust’s most anticipated annual events, the Board of Directors is extremely grateful to our historic homeowners who by sharing their extraordinary homes allow us to better understand the significant and unique history of our community. The annual house tour provides an opportunity for our historic community to showcase their neighborhood architectural heritage and demonstrate how historic homes can be a perfect fit for our modern lives. Opening their doors to 300 guests, the House Tour raised $15,000 to benefit the final phase of the rebuilding effort of the Jones Log Barn in Chesterbrook as a living history museum.

Not only were the houses interesting and diverse but the volunteers were incredibly knowledgeable. They also seemed to really enjoy the history of each house. I will definitely sign up again next year.”

6 Weeks Until the General Election, Did Chester County Voter Services ‘Fix’ their Malfunctioning Voting Machines?

In 6 weeks, the voters of Chester County will go to the polls for the General Election. Looking back to the Primary Election on May 17, do we have assurance from the Chester County Voter Services that there will be no repeat performance of malfunctioning voting machines?

Chester County Voter Services found irregularities in vote counts in over 100 precincts in Chester County due to equipment malfunctions. But here in Tredyffrin Township, the outcome of the Special Election was dramatically affected by the malfunctioning machines. If you recall, on election night, the results posted on the Chester County Voter Services website indicated that Molly Duffy (D) had a 44-vote lead over Mike Heaberg (R). However, as irregularities in the Tredyffrin precinct counts emerged, a full manual recount was required. It was discovered that 62 ballots were not counted by the voting machines. Adding to the mystery, was the discovery that all 62 uncounted ballots were Republican ballots. In the final hand count, Heaberg emerged as the winner by a 2-vote margin. Duffy and Heaberg, along with legal representation attended the manual recount and agreed to the reconciliation results.

But ‘why’ did the voting machines malfunction in the first place? Do we as voters have an assurance that the problem has been corrected? Is their confidence that our vote really will count on Election Day?

A follow-up report from Chester County Voter Services was published Friday, September 23 on their website. However, it is interesting to note that the report is dated two months earlier — July 14, 2011. Since the report is ‘To the Public’, wonder why it took so long for it to be ‘public’.

Chester County Voter Services conducted extensive testing. According to their findings, “It was discovered through our testing of those printed Republican Ballots that a dark blue “color bar” was printed outside the specified area on those ballots. Samples of these ballots were eventually sent to Election Systems & Software, Inc. in Birmingham, Alabama to review the specifications of the ballots printed by Dayton Legal Blank. ES&S was able to determine that the color bar printed on the Republican Ballots was printed outside the specified area on the ballot for any ES&S M-100 tabulator to properly function”.

The report further states “. . . the printed dark blue color bar printed on the Republican Ballots was the sole cause for the M-1000 to not read these invalidly printed Republican Ballots.”

In their closing remarks, the report from Chester County Voter Services states, “we will ensure that we maintain our electronic equipment on a routine yearly schedule and we will ensure our Primary Election ballots are printed in conformance with the ES&S ‘Color Stripe Specification’ ”

So we officially know ‘why’ the voting machines malfunctioned for the Primary Election – an alignment printing issue.

Voter Services promises that they will maintain the equipment on a yearly schedule. I would feel more confident in the system if there was a degree of responsibility; plus assurance that they will run ‘test ballots’ through the voting machines prior to November’s General Election.

Elections are important and all votes count! The ‘every vote counts’ importance was brought home to Tredyffrin voters in the Special Election race between Molly Duffy and Mike Heaberg where the winner was decided by 2 votes!

Mark your calendars for November 8 and plan on having your voice heard through your vote in the General Election.
